Terms of Service

Welcome to ArtifactNet, a forensic AI-music detection service operated by Intrect ("we", "us", "our"). By accessing or using the ArtifactNet API, dashboard, demo, or SDK (collectively, the "Service"), you ("you", "user") agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.

1. Eligibility

• You must be at least 16 years old or the age of digital consent in your jurisdiction.
• You must register with a valid Google account or verified email.
• You may not use the Service if you are barred from doing so under applicable law.

2. Account & Authentication

• You are responsible for safeguarding your credentials, API keys, and JWT tokens.
• You must notify us immediately at [email protected] of any unauthorized use of your account.
• We may suspend or terminate accounts engaged in abuse, scraping, or attempts to circumvent rate limits or quotas.

3. Permitted Use

You may use the Service to analyze audio files that you own, that you have explicit permission from the rights holder to analyze, or that fall under fair use / fair dealing in your jurisdiction (e.g. journalism, research, educational review).

4. Prohibited Use

You agree NOT to:

• Reverse-engineer, distill, or attempt to extract the underlying machine learning models or training data via API queries or any other means.
• Submit content that is unlawful, infringing, defamatory, or contains malware.
• Use the Service to harass, defame, or wrongfully accuse any individual or entity of producing AI-generated music. ArtifactNet provides forensic indicators, not conclusive legal proof (see Disclaimer).
• Use the Service to develop competing products or train alternative ML models.
• Exceed the rate limits or quotas of your tier.
• Share, resell, or publicly disclose results in a manner that misrepresents ArtifactNet's verdicts as authoritative classifications.

5. Subscription & Billing

Paid tiers renew automatically. You may cancel at any time; cancellations take effect at the end of the current billing period. Refunds are issued at our discretion for verified service outages.

6. Intellectual Property

Intrect retains all rights, title, and interest in the Service, including the ArtifactNet models, source code, and documentation. You retain ownership of audio files you submit. We do not claim any rights over your input audio beyond what is necessary to provide the Service.

7. Service Availability

We strive for high availability but do not guarantee uninterrupted operation. Scheduled maintenance, third-party outages (e.g. Google OAuth, RunPod), or force majeure events may temporarily affect access.

8. Limitation of Liability

To the maximum extent permitted by law, Intrect's total liability arising from your use of the Service is limited to the greater of (a) the fees you paid in the 12 months preceding the claim, or (b) USD 100. Intrect is not liable for indirect, incidental, consequential, special, or punitive damages.

9. Indemnification

You agree to indemnify and hold Intrect harmless from any claims arising out of (a) your violation of these Terms, (b) your misuse of the Service, or (c) your infringement of third-party rights through content you submit or actions you take based on ArtifactNet outputs.

10. Modifications

We may update these Terms from time to time. Material changes will be announced on our dashboard and via email at least 14 days before they take effect. Continued use after the effective date constitutes acceptance.

11. Termination

We may suspend or terminate your access immediately for breach of these Terms. You may close your account at any time via the dashboard. Upon termination, your data is retained per the Privacy Policy and then deleted.

12. Governing Law

These Terms are governed by the laws of the Republic of Korea, without regard to conflict-of-law principles. Disputes shall be resolved in the courts of Seoul, Republic of Korea.
